1. Legal Agreement, Scope of Application<\/h2>\n

1.1<\/strong> These Terms of Service (\u201eTerms of Service<\/strong>\u201d) constitute a legally binding agreement between you and Autodarts GmbH, Siegfriedstra\u00dfe 23, 64625 Bensheim, registered with the Commercial Register of the Local Court (Amtsgericht<\/em>) of Darmstadt under HRB 106094(\u201cAutodarts<\/strong>\u201d). The current version of these Terms of Service is available at https:\/\/play.autodarts.io<\/u><\/a>.<\/p>\n

In this agreement, the terms \u201ewe\/us\/our\u201c refer to Autodarts, while \u201cyou\/your\u201d refer to you as a user of our services. These Terms of Service apply in connection with the use of the \u201cAuto Darts Play<\/strong> Services<\/strong>\u201d (each individually a \u201cService<\/strong>\u201d).<\/p>\n

The Autodarts Play Services include, in particular: (i) the download and operation of the Autodarts Desktop Software, which installs and controls the recognition software; (ii) the operation of the recognition software, which detects the darts as well as their positions and coordinates and forwards this information to Autodarts Play; (iii) the operation of Autodarts Play, an online platform that utilizes the information provided so that individual players can subsequently play darts against each other online.<\/p>\n

The dartboard camera captures images of the dartboard in order to identify the position of the darts on the dartboard. Only images are captured; no video recordings are made.<\/p>\n

The software analyzes the recordings of the connected dartboard camera, which are also stored. The recognition software collects the captured data and operates locally on the respective computer's operating system. It then transmits the collected data to Autodarts Play, which is operated as an online platform. Within the online platform, individual players can subsequently use this information to play against each other online.<\/p>\n

1.2<\/strong> The Terms of Service described herein apply to you when you visit our website and use the Autodarts Play Services. Before using the Service or any individual component thereof, these Terms of Service must be carefully read and accepted by the user.<\/p>\n

1.3<\/strong> By using the Autodarts Play Services, you agree to accept and be bound by the terms and conditions set forth in these Terms of Service. Furthermore, you agree to comply with all rules of conduct made available to you by Autodarts either directly or through the website. All user identities created on the website are subject to these Terms of Service.<\/p>\n

1.4<\/strong> A prerequisite for using the Autodarts Play Services is that you, as a user, accept the following Terms of Service. Any objection to individual provisions or to all provisions of these Terms of Service shall exclude the right to use the Service, including access to its content and functionalities.<\/p>\n

1.5<\/strong> You acknowledge and agree that the Service may include service announcements and administrative communications, and that you may not have the right to opt out of receiving such communications.<\/p>\n

1.6<\/strong> This Agreement supplements and in no way replaces any additional terms and conditions that may apply to the use of or access to certain other products or services of Autodarts, services provided by partners, third-party content, or third-party software. In the event that the content of this Agreement conflicts with one or more provisions of one or more other specific agreements or Terms of Service, the provision(s) of the specific agreement or Terms of Service shall prevail.<\/p>\n

2. Services Provided by Autodarts<\/h2>\n

2.1<\/strong> Autodarts grants you the right to use the current version of the Autodarts Play Services as made available from time to time.<\/p>\n

2.2<\/strong> Furthermore, Autodarts grants you a limited-term right to install, use, and reproduce Autodarts Desktop and the recognition software on your system after downloading them from Apple's software distribution platform (\u201cApp Store<\/strong>\u201d), Google's software distribution platform (\u201cPlay Store<\/strong>\u201d), or Linux's software distribution platform (\u201cFlathub<\/strong>\u201d), in accordance with these Terms of Service.<\/p>\n

In addition, users may purchase paid subscriptions (Plus Membership) directly within the app via the Apple App Store and Google Play Store. Such in-app purchases shall additionally be governed by the provisions set out in Section 7.<\/p>\n

2.3<\/strong> Autodarts is not responsible for installing the software on your system. You are solely responsible for the installation.<\/p>\n

2.4<\/strong> Autodarts may, without being obligated to do so, update or further develop the Autodarts Play Services at any time and, in particular, adapt them in response to changes in the legal framework, technological developments, or for the purpose of improving IT security. When we update our software as part of the Service, we may use an update routine to verify whether the latest version of the client software is installed on your computer or device. Updates will generally be performed automatically. You are required to use the most current version of the Service at all times, as otherwise essential security features and software functionalities may be impaired or become unavailable.<\/p>\n

2.5<\/strong> Autodarts reserves the right to suspend the Service or any part thereof from time to time, either on a scheduled basis or otherwise, with or without prior notice, in order to perform maintenance work. You further acknowledge that the Service, or parts thereof, may be interrupted for reasons beyond our control, and that we cannot guarantee that you will be able to access the Service whenever you wish to do so.<\/p>\n

2.6<\/strong> Subject to applicable law (including any non-excludable rights), we reserve the right to modify and\/or discontinue any aspect of the Service at any time, with or without cause and at our sole discretion.<\/p>\n

2.7<\/strong> Autodarts assumes no custodial, safekeeping, or data retention obligations with respect to any data hosted by Autodarts on your behalf. You are solely responsible for maintaining adequate backups of your data.<\/p>\n

3. Scope of Use and Rights<\/h2>\n

3.1<\/strong> Upon acceptance of these Terms of Service, you are granted a non-exclusive, non-sublicensable, non-transferable right, limited in duration to the term of these Terms of Service, to use the then-current version of the relevant software application and the Autodarts Play Services in accordance with the provisions of these Terms of Service.<\/p>\n

3.2<\/strong> The use of the Autodarts Play Services is permitted exclusively for private, non-commercial purposes. In particular, you are prohibited from, and agree not to, either directly or through third parties:<\/p>\n

    \n
  1. selling, reselling, renting, leasing, licensing, sublicensing, transferring, or otherwise commercially exploiting the Autodarts Play Services, the website, or any protected materials, including, without limitation, through third parties using external software solutions or locally installed applications that access the interface. This prohibition also applies to any form of automated or indirect use through third-party software;<\/li>\n
  2. distributing, publicly performing, making publicly available, or modifying the Autodarts Play Services, except as necessary for their intended use in connection with gameplay;<\/li>\n
  3. modifying, adapting, creating derivative works of, or circumventing any technical protection measures relating to the Autodarts Play Services;<\/li>\n
  4. extracting data from the Autodarts Play Services (e.g., through data mining, scraping, or other automated methods);<\/li>\n
  5. using unauthorized connections, servers, emulators, or third-party software to operate, access, modify, or interfere with the Autodarts Play Services or any games offered through the Services;<\/li>\n
  6. removing, altering, or obscuring any copyright notices, trademarks, proprietary notices, or other ownership markings.<\/li>\n<\/ol>\n

    3.3<\/strong> The disclosure, publication, distribution, or public reproduction of any content, software, or protected materials to third parties is prohibited. Simultaneous access from more than one device is permitted only to the extent expressly provided for by the Autodarts Play Services.<\/p>\n

    3.4<\/strong> Commercial use of any service hosted by Autodarts, as well as the provision of such service to third parties, may be permitted on a case-by-case basis subject to Autodarts prior written consent.<\/p>\n

    3.5<\/strong> For the purposes of these Terms of Service, \u201ccommercial use\u201d shall include any situation in which natural or legal persons enable third parties to use the Autodarts Play Services in exchange for payment, including where the Autodarts Play Services are made available to guests, customers, or other users for consideration in the course of a business operation.<\/p>\n

    3.6<\/strong> You are entitled to decompile the source code of the Autodarts Play Services only to the extent permitted under Section 69e of the German Copyright Act (Urheberrechtsgesetz \u2013 UrhG<\/em>). Any other form of decompilation, copying, reverse engineering, disassembly, or similar activities in connection with the Autodarts Play Services is expressly prohibited.<\/p>\n

    3.7<\/strong> All designs, texts, graphics, logos, trademarks, software, databases, functionalities, and other components of the Autodarts Play Services (collectively, the \u201cIntellectual<\/strong> Property<\/strong>\u201d or \u201cIP<\/strong>\u201d) are owned by Autodarts or have been licensed to Autodarts by third parties and are protected by copyright, trademark, and other intellectual property laws, in particular under German and European law.<\/p>\n

    No ownership rights or exploitation rights in the Intellectual Property are granted to users. Use of the Intellectual Property is permitted solely within the scope of these Terms of Service. Any reproduction, public communication, modification, adaptation, further processing, or other use of the Intellectual Property beyond the intended use of the Autodarts Play Services is prohibited without our prior express authorization in text form.<\/p>\n

    3.8<\/strong> During gameplay, you grant Autodarts an exclusive, transferable, sublicensable, worldwide, and perpetual right to use the images of your dartboard captured by the Autodarts Play Services. Such images are captured either through a dartboard purchased from Autodarts or through a self-built dartboard equipped with camera functionality that has been properly connected to our Services by you.<\/p>\n

    This right includes, in particular, the right to use the captured images for product improvement purposes (for example, correcting faulty dartboard system calibrations through the Autodarts Board Manager) and for the further development of the Services and related artificial intelligence models.<\/p>\n

    4. User Content and Interactive Areas<\/h2>\n

    4.1<\/strong> The Service may include discussion forums, chat rooms, user feedback features, messaging functionalities, comment sections, and other interactive areas or services (collectively, the \u201cInteractive Areas<\/strong>\u201d) through which you or other users may create, post, transmit, submit, store, or otherwise make available content such as messages, materials, data, information, text, music, audio, images, photographs, videos, graphics, code, or other items or materials on or through the Website or any other part of the Service (collectively, the \u201cUser Content<\/strong>\u201d).<\/p>\n

    We expressly state that under no circumstances do we adopt, endorse, or assume responsibility for any User Content as our own.<\/p>\n

    4.2<\/strong> User Content may, where applicable, be publicly accessible and\/or available to a broader group of users beyond your control, particularly in connection with chat or forum functionalities. The publication of personal data relating to yourself or third parties is expressly prohibited, and you undertake to refrain from doing so. You further undertake not to store, process, or distribute User Content without authorization.<\/p>\n

    4.3<\/strong> In particular, you agree not to post, upload, transmit, distribute, store, create, or otherwise publish any of the following:<\/p>\n

    4.3.1<\/strong> User Content that is unlawful, libelous, defamatory, obscene, pornographic, indecent, lewd, offensive, sexually suggestive, harassing, threatening, invasive of privacy or publicity rights, abusive, inflammatory, fraudulent, or otherwise objectionable;<\/p>\n

    4.3.2<\/strong> User Content that constitutes, encourages, promotes, or provides instructions for a criminal offense, infringes the rights of any party, creates liability, or otherwise violates any applicable local, state, national, or international law;<\/p>\n

    4.3.3<\/strong> User Content that may infringe any patent, trademark, trade secret, copyright, intellectual property right, or other proprietary right of any party. By posting User Content, you represent and warrant that you have the legal right to distribute and reproduce such User Content;<\/p>\n

    4.3.4<\/strong> User Content in which a person impersonates another natural person or legal entity, or otherwise falsely represents your affiliation with any natural person or legal entity;<\/p>\n

    4.3.5<\/strong> Unsolicited promotions, political campaigning, advertising, marketing communications, or solicitations;<\/p>\n

    4.3.6<\/strong> Private information of third parties, including, without limitation, addresses, telephone numbers, email addresses, social security numbers (or equivalent identifiers in other jurisdictions), and credit card numbers;<\/p>\n

    4.3.7<\/strong> Viruses, corrupted data, malware, or any other harmful, disruptive, or destructive files, code, or materials.<\/p>\n

    4.4<\/strong> Autodarts expressly reserves the right to remedy violations of these provisions immediately and without prior notice by taking appropriate measures in individual cases, and to pursue civil and\/or criminal remedies where appropriate. In particular, we refer to the provisions set out in Section 10.<\/p>\n

    5. Registration and Activation of an Autodarts Login<\/h2>\n

    5.1<\/strong> Full use of the Autodarts Play Services requires the creation of a user account on A Play through redirection to login.autodarts.io (the \u201cAutodarts<\/strong> Login<\/strong>\u201d).<\/p>\n

    5.2<\/strong> Use of the Autodarts Play Services is permitted only if you have reached the minimum age of seven (7) years (the \u201cMinimum Age<\/strong>\u201d), unless a higher minimum age is required by applicable law. In addition to this Minimum Age requirement, the following applies: If, under the laws of your country or region, you are not legally authorized to enter into agreements relating to the use of the Services or to accept these Terms of Service, you must obtain the consent of your parent(s), legal guardian(s), or other legal representative(s). Please have your parent(s) or legal guardian review and confirm these Terms together with you. The provisions of Section 7 shall additionally apply to any paid subscriptions. As part of the registration process, users are required to accept these Terms of Service.<\/p>\n

    6. Exclusive Private Use<\/h2>\n

    6.1<\/strong> As set forth in Section 3, Autodarts permits the use of the Autodarts Play Services exclusively for private, non-commercial purposes. Commercial use by third parties, in particular through external software solutions or locally installed applications that access the interface, is prohibited. This prohibition also applies to any form of automated or indirect use through third-party software that has not been expressly authorized in writing by Autodarts.<\/p>\n

    6.2<\/strong> In the event of any violation of these provisions, Autodarts reserves the right to take legal action, including, without limitation, extraordinary termination of the contractual relationship.<\/p>\n

    7. Paid Subscription<\/h2>\n

    7.1<\/strong> Autodarts reserves the right to introduce paid subscriptions (\u201cSubscriptions<\/strong>\u201d and individually a \u201cSubscription<\/strong>\u201d) for Autodarts Play, which may be offered to users in addition to the free version of the Service. Under a Subscription, users may be granted access to additional features, extended functionality, and other benefits relating to the use of Autodarts Play. The provisions of this Section 7 shall apply in addition to the other provisions of these Terms of Service for users holding a Subscription.<\/p>\n

    7.2<\/strong> A Subscription may only be purchased by users who are at least eighteen (18) years of age and have full legal capacity to enter into binding contracts.<\/p>\n

    7.3<\/strong> The purchase of a Subscription is entirely voluntary and requires the user's prior express consent. Current pricing and available Subscription plans can be viewed on the Autodarts website at: https:\/\/autodarts.io\/pricing-autodarts<\/a>. Any additional terms and conditions applicable to the respective Subscription shall also apply.<\/p>\n

    7.4<\/strong> Autodarts reserves the right to adjust the fees payable for paid Subscriptions. Autodarts will notify Subscription users of any price change in text form at least six (6) weeks in advance. In such case, the user shall have the right to terminate the Subscription agreement effective at the end of the month following the month in which the notice was given. Termination may be effected through the designated area of the Autodarts Play online platform. Section 7.11 shall apply accordingly.<\/p>\n

    7.5<\/strong> In connection with Subscription services, Autodarts uses the payment processing and invoicing services of Stripe Technology Company Limited (STC), One Wilton Park, Wilton Place, Dublin 2, D02 FX04, Ireland, and Stripe, Inc., 354 Oyster Point Boulevard, South San Francisco, California 94080, United States (\u201cStripe\u201d), acting as merchant of record and authorized reseller on behalf of Autodarts.<\/p>\n

    7.6<\/strong> Where users purchase a Subscription through the Apple App Store or Google Play Store, payment processing shall be handled by Apple Inc. or Google LLC, respectively, in accordance with the applicable store terms and conditions (including the Apple Media Services Terms and Conditions and the Google Play Terms of Service). In such cases, Stripe is not involved in the payment process. Apple Inc. and Google LLC act as independent payment service providers, and no direct contractual relationship between the user and Stripe is established with respect to such purchases.<\/p>\n

    7.7<\/strong> The user shall first select the desired Subscription and subsequently provide the personal data required for contract processing. By clicking the applicable order button (for example, \u201cOrder with Obligation to Pay\u201d or a similar designation), the user submits a legally binding offer to conclude the respective Subscription agreement. Following submission of the order, payment processing will be carried out through Stripe. Invoices shall be issued exclusively by Stripe; Autodarts does not send invoices directly to users.<\/p>\n

    7.8<\/strong> Invoices will be sent to the email address stored in the user's account at the time the Subscription is purchased. At present, changes to this email address can only be made through Autodarts customer support.<\/p>\n

    7.9<\/strong> For Subscriptions purchased through the Autodarts Play website or web platform, the agreement relating to the paid Subscription is concluded between you and Stripe. For Subscriptions purchased through the Apple App Store or Google Play Store, the Subscription agreement is concluded directly between you and Autodarts, while payment processing is performed by Apple Inc. or Google LLC as payment service providers. The Stripe Terms and Conditions shall additionally apply and are available at: https:\/\/stripe.com\/en-de\/legal<\/a>. Further information regarding Stripe is available at: https:\/\/www.stripe.com<\/a>.<\/p>\n

    7.10<\/strong> If a user remains in default of a due payment for more than four (4) weeks, Stripe and\/or Autodarts shall be entitled, following a prior reminder and the expiration of a reasonable cure period, to restrict or suspend the user's access to paid features. Such restriction or suspension shall not affect any existing or future payment obligations, including payment obligations arising during the period of restriction or suspension. Once all outstanding amounts have been paid in full, Autodarts shall promptly restore access to the Subscription and all associated features.<\/p>\n

    7.11<\/strong> Users may terminate a Subscription at any time without observing a notice period. Termination shall be effected through the user's personal account area within Autodarts Play. Users will be redirected to Stripe, through which the Subscription is administered, and termination may then be completed in accordance with Stripe's cancellation process. Following successful cancellation, the Subscription shall remain active until the end of the billing period already paid for. Users may continue to use the selected Subscription until the expiration of its term. Access to all Subscription services and features shall automatically cease at the end of the Subscription term. No refunds shall be granted for unused portions of a billing period. Where a Subscription was purchased through the Apple App Store, cancellation must be completed exclusively through the user's Apple account subscription settings (Settings > [Name] > Subscriptions). Where a Subscription was purchased through the Google Play Store, cancellation must be completed exclusively through the subscription settings of the user's Google Play account. In such cases, cancellation directly with Autodarts is neither possible nor required. The Subscription shall terminate at the end of the billing period already paid for following cancellation through the applicable store.<\/p>\n

    8. Third-Party Content<\/h2>\n

    Autodarts reserves the right to provide or make available third-party content through the Service and to provide links to third-party websites and content (collectively, the \u201cThird-Party Content<\/strong>\u201d) as a service to users who may be interested in such information. We do not monitor or control any Third-Party Content hosted on third-party websites. We do not endorse, approve, or assume responsibility for any Third-Party Content and make no representations or warranties regarding the accuracy, completeness, legality, reliability, or suitability of any Third-Party Content.<\/p>\n

    We further disclaim any responsibility for the accuracy of information contained in Third-Party Content and may, at our sole discretion, refrain from updating, reviewing, or monitoring such content.<\/p>\n

    9. Information and Support<\/h2>\n

    9.1<\/strong> Autodarts provides a support service for inquiries relating to the functionality and operation of the Autodarts Play Services.<\/p>\n

    9.2<\/strong> Users may also contact Autodarts with general inquiries, suggestions for improvement, complaints, or legal claims using the following contact details:<\/p>\n

    9.3<\/strong> Autodarts is under no legal obligation to respond to support requests.<\/p>\n

    10. Your Obligations<\/h2>\n

    10.1<\/strong> You are required to inspect and verify the proper functioning of the Autodarts Play Services immediately after installation.<\/p>\n

    10.2<\/strong> You are responsible for ensuring that the Autodarts Play Services are used solely within the contractually agreed scope and in compliance with applicable law. Any unauthorized access to the Autodarts Play Services must be reported to Autodarts without undue delay.<\/p>\n

    10.3<\/strong> The Autodarts Play Services may also be used by minors, particularly in accordance with the provisions set out in Section 5.2. You acknowledge this and undertake at all times to act responsibly, to respect and promote the protection of minors, and to actively support this objective by reporting any violations, in particular criminal conduct, abuse, or harassment.<\/p>\n

    10.4<\/strong> To the extent that you upload data for use in connection with the Autodarts Play Services (for example, profile pictures), you must ensure that such data is checked for viruses or other harmful components and that appropriate state-of-the-art security measures (such as antivirus software) are used.<\/p>\n

    10.5<\/strong> You represent and warrant to Autodarts that any content and data stored on Autodart's servers, as well as their use and provision by Autodarts in accordance with your instructions, do not violate any applicable laws, governmental orders, third-party rights, or agreements with third parties. You shall indemnify and hold harmless Autodarts, upon first demand, from and against any claims asserted by third parties arising out of or relating to a breach of this Section.<\/p>\n

    10.6<\/strong> You represent and warrant to Autodarts that you will conduct yourself during gameplay in a lawful, respectful, fair, and sportsmanlike manner. Autodarts expects its users to respect the community and to comply with all applicable local laws. By accepting these Terms of Service, you agree to respect the community and comply with all applicable local laws.<\/p>\n

    10.7<\/strong> Any use of the Autodarts Play Services, including the Interactive Areas or any other part of the Services, that violates these Terms of Service may result, among other consequences, in the suspension or termination of your right to use the Service or any part thereof. To the extent permitted by applicable law, Autodarts may, without prior notice or warning, take any reasonable measures it deems necessary to prevent, investigate, remedy, or sanction violations of these Terms of Service or any other unlawful or inappropriate conduct.<\/p>\n

    11. Limitation of Liability<\/h2>\n

    11.1<\/strong> A shall not be liable for damages caused by ordinary negligence, regardless of the legal basis, in connection with the provision of free Autodarts Play Services.<\/p>\n

    11.2<\/strong> Autodarts liability for damages caused by ordinary negligence, regardless of the legal basis, in connection with paid Autodarts Play Services shall be limited as follows:<\/p>\n
